PERSONAL USAGE LICENSE AGREEMENT

1. LICENSE GRANT
   This license grants you, the purchaser, non-exclusive, worldwide rights to use the purchased image for personal, non-commercial purposes including:

• Social media posting (Instagram, Facebook, Twitter, etc.)
• Personal blogs and websites
• Personal prints and displays
• Personal digital devices
• Personal presentations
• Personal email communications
• Personal photo albums and collections

1. RESTRICTIONS
   The following activities are strictly prohibited:

• Commercial use of any kind
• Resale or redistribution of the image
• Sub-licensing or transfer of license rights
• Use in products intended for sale
• Modification that alters the essential nature of the image
• Claiming ownership or copyright of the image
• Use in defamatory, pornographic, or unlawful content
• Distribution through stock photo websites
• Integration into logos or trademarks

1. DURATION AND TERRITORY

• This license is perpetual and worldwide
• Rights are non-transferable
• License remains valid as long as terms are met

1. COPYRIGHT

• All copyright and intellectual property rights remain with the photographer
• Original watermarks must remain intact where applicable
• Credit to photographer is appreciated but not required for personal use

1. TERMINATION
   This license automatically terminates if any terms are breached. Upon termination:

• All usage rights cease immediately
• All copies must be deleted or destroyed
• No refunds will be provided

COMMERCIAL USAGE LICENSE AGREEMENT

1. LICENSE GRANT
   This license grants you, the purchaser, non-exclusive, worldwide rights to use the purchased image for commercial purposes including:

• Marketing and advertising campaigns
• Company websites and social media
• Product packaging and merchandise
• Print and digital media
• Commercial displays and presentations
• Corporate communications
• Digital and print advertisements
• Editorial content
• Business presentations
• Commercial broadcasts

1. PERMITTED ACTIVITIES

• Worldwide usage rights
• Multiple projects and platforms
• Image modification and editing
• Integration into commercial products
• Corporate communications
• Digital and print reproduction
• Public display and distribution
• Creation of derivative works
• Storage in digital asset systems

1. RESTRICTIONS
   The following activities are prohibited:

• Resale of the image as a standalone file
• Sub-licensing to third parties
• Transfer of license rights
• Use in trademarks or logos without additional permission
• Pornographic, defamatory, or unlawful use
• Distribution through stock photo websites
• False attribution of ownership
• Use that implies endorsement

1. DURATION AND TERRITORY

• Perpetual worldwide commercial usage rights
• Non-transferable license
• Valid for multiple projects and campaigns
• No geographical restrictions

1. COPYRIGHT AND ATTRIBUTION

• Copyright remains with the photographer
• Attribution required in editorial contexts
• Watermarks must remain intact where applicable
• Proper credit format: “© Thomas Wendt Photography”

1. USAGE TRACKING AND REPORTING

• Usage tracking may be implemented
• Annual usage reports may be requested
• Significant uses should be reported

1. TERMINATION
   License terminates automatically if terms are breached:

• All usage rights cease immediately
• All copies must be deleted or destroyed
• No refunds will be provided
• Liability for damages may apply

1. LIABILITY AND INDEMNIFICATION

• Licensee assumes all liability for use
• Indemnifies photographer against claims
• Responsible for third-party clearances
• Must maintain proper records of usage
